DEHRADUN: A two-judge bench of Uttarakhand high court on Wednesday upheld an order issued about a month ago quashing the state education department's order of allowing only those to apply for Teacher Eligibility Test (TET) who had secured at least 45% marks in Bachelor in Education (B.Ed.).
The bench turned down a petition filed by a solicitor on behalf of the state government.
Chief Justice Barin Ghosh and Justice Sarvesh Gupta's bench delivered the verdict on a petition filed on behalf of Uttarakhand education department about a month after HC single-judge bench had stayed government order making only those eligible to appear for TET who had obtained at least 45% marks in B.Ed.
Describing the state order as discriminatory and unfair, the bench said as all applicants are professionally trained in the same course, it is not fair to bar any one from appearing in TET.
The court judgment that came barely four days ahead of TET is slated to be held, has been welcomed by most applicants. "By delivering a judgment in favour of all aspirants, court has really done justice with all of us," said an applicant in Dehradun.
